    Terms and Conditions

    With our market-leading warranty, you can rest assured that your investment is well protected. Your Dura Composites warranty will commence on our acceptance of your submitted warranty application form and proof of purchase, which must be submitted within 30 days of your invoice date.

    This warranty is given to the Purchaser of Dura Composites’ (the Seller’s) product solutions. For purposes of this warranty, “Purchaser” shall refer to the named person who completes the online warranty activation form.

    The Purchaser’s warranty application is specific to the product(s) stated on the Sales Order Acknowledgement from Dura Composites.

    Products must be installed in strict accordance with the guidance in our free downloadable Technical Installation Manuals and supporting literature (where available), or as per Dura Composites manufacturer’s instructions provided as part of your technical sales consultation.

    Subject to the conditions set out below the Seller warrants that the Goods at the time of delivery will be free from defects in material and workmanship.

    The Seller may agree with the Purchaser to issue a warranty specific to the product type (see tabs below for details of the warranty offered for each material type). Any Purchaser wishing to apply for this must do so within 30 days of their invoice date at duracompstage.wpengine.com/warranty and provide proof of purchase.

    The warranty is given by the Seller subject to the following conditions:
    The Seller shall be under no liability in respect of any defect in the Goods arising from any drawing, design or specification supplied by the Purchaser;
    The Seller shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow the Seller’s instructions (whether oral or in writing within the Seller’s Technical Installation Manuals), misuse or alteration or repair of the Goods without the Seller’s approval;
    The Seller shall be under no liability under the above warranty (or any other warranty, condition or guarantee) if the total price for the Goods has not been paid by the due date for payment;

    The above warranty does not extend to parts, materials or equipment not manufactured by the Seller, in respect of which the Purchaser shall only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to the Seller.

    Subject as expressly provided in these conditions all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

    Any claim by the Purchaser which is based on any defect, shall (whether or not delivery is refused by the Purchaser) be notified to the Seller within 7 days from the date of delivery or (where the defect of failure was not apparent on reasonable inspection) within a reasonable time after discovery of the defect or failure. If delivery is not refused, and the Purchaser does not notify the Seller accordingly, the Purchaser shall not be entitled to reject the Goods and the Seller shall have no liability for such defect or failure, and the Purchaser shall be bound to pay the price as if the Goods had been delivered in accordance with the contract.

    The Purchaser must include in any claim their proof of purchase and a statement explaining the defect. Dura Composites may request additional information and/or detailed photographs. After reviewing the information, Dura Composites will make a determination regarding the validity of the claim. If Dura Composites determines that the Purchaser’s claim is valid, Dura Composites will, at its option, either replace the defective product(s) with the same or next best similar item, or refund the portion of the purchase price paid by Purchaser relating to the defective Dura product(s) (not including any initial installation costs if applicable). The Seller shall have no further liability to the Purchaser, save possibly the cost of transport of the replaced goods, and then one way only.

    Except in respect of death or personal injury caused by the Seller’s negligence, the Seller shall not be liable to the Purchaser by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of the Seller, its employees or agents or otherwise) which arise out of or in connection with the supply of the Goods or their use or resale by the Purchaser, except as expressly provided in these Conditions.

    The Seller shall not be liable to the Purchaser or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of the Seller’s obligations in relation to the Goods, if the delay or failure was due to any cause beyond the Seller’s reasonable control. Without prejudice to the generality of the foregoing, causes beyond the Seller’s reasonable control: shall include inter alia flood, fire, accident, threat or war, civil disturbance. Acts or bye laws, import or export regulations, strikes, industrial action, breakdown of machinery, difficulties in obtaining raw materials, labour, fuel, parts or machinery.

    Exclusions from Warranty Coverage: Dura Composites does not warranty against and is not responsible for, and no implied warranty shall be deemed to cover product failure, product malfunction, or damages attributable to: (1) improper installation of the Dura products and/or failure to abide by Dura Composites installation techniques, including but not limited to improper gapping; (2) use of the Dura Composite products beyond specified load values or in an application not recommended by Dura Composites; (3) movement, distortion, collapse or settling of the ground or the supporting structure on which the products are installed; (4) any natural disaster (flooding, hurricane, earthquake, lightning etc) environmental condition (such as air pollution, mould, mildew etc.) or staining from foreign substances (such as dirt, grease, oil etc); (5) major variations or changes in colour of the products; (6) normal weathering of the anti-slip surface of the product or normal weathering of the product due to exposure to sunlight, weather and atmosphere which can cause coloured surfaces to, amongst other things, accumulate dirt or stains; or (7) improper handling, storage, abuse or neglect of the Dura Composites products by Purchaser, the transferee or third parties.

    The Seller may delay delivery or terminate the contract at any time by immediate notice without Liability to the Purchaser.

    Limitations: DISCLAIMER OF WARRANTIES: Except for the express warranty contained herein, Dura Composites makes no other warranties, guarantees or indemnities, whether express or implied, arising by law, course of dealing, usage of trade, custom or otherwise, including but not limited to the implied warranty of saleability and implied warranty of fitness for a particular purpose, and all such other warranties, guarantees and indemnities are hereby disclaimed, overridden and excluded from this transaction.

    Limitation of remedies and exclusion of consequential and incidental damages: Dura Composites liabilities are limited solely and exclusively to the obligations specifically undertaken herein, and under no circumstances will Dura Composites be liable or obligated for any incidental, consequential, indirect, special, punitive or any other damages of any kind whatsoever (including, but not limited to, lost profits, lost sales, loss of goodwill, use of money, use of goods, stoppage of work, or impairment of assets), whether foreseeable or unforeseeable, arising out of breach or failure of express or implied warranty, breach of contract, fraud, misrepresentation, law of mandatory application. Dura Composites liability with respect to defective products shall in no event exceed the replacement of such products or refund of the purchase price, as described above.

    The warranty may not be altered or amended except in a written instrument signed by Dura Composites and Purchaser or permitted transferee. No agent, employee or any other party is authorised to make any warranty in addition to that made in this agreement.
